A while back I had a nasty conversation with a sibling where I argued about religion in a pretty bad way. As a result they made pretty problematic statements like claiming that something in Islam might be legal but wrong according to "humanity". Eventually they got angry and conceded "Islam is right." when I pushed them (they weren't conceding the statement for a while) but they seemed angry about it and left. I definitely regret having that conversation in retrospect and I'll hold my tongue in the future but can I legally consider them Muslim still? They come in my room often and worrying about najasat would cause me trouble.

Ask your marja

If your family believe in the shahadah then they are Muslim although not practicing.

My sibling is semi-practicing (she does a few of the 5 daily prayers). I believe it was just a bad conversation.

There are a lot of people who identify as Muslim and are practicing who may be unaware of many nuances of their religion who have not thought every detail of their religion through in relation to their own perspectives/thoughts - as in, many are unstudied or don't reflect.

I.e, there's a lot lot Liberal minded Muslims out there brought up on Western values who may not recognize certain values of their religion because they've been brainwashed.

Of course, I'm not saying that's your sibling's situation, I'm just showing a parallel - to tell you that we can't do takfir on them or treat them like they are disbelievers. They submit to God's Oneness and the Holy Prophet's role, they're Muslim. Everyone's growing and learning at their own pace and acceptance.

Yes. Statements made in moments of anger/frustration/depression do not count as apostasy.

as long as one doesn't disbelieve in one of the Tawheed, Nubuwwah, Maad. and doesn't disbelieve islam was legislated dhuriyyatul deen (like wajibness of salah, fasting and prohibition of drinking wine) then they just have problematic ideas if they are wrong and we can consider them within the folds of Islam. also if someone does reject something big like that which entails rejecting something certainly Islamic we must not jump so fast maybe they don't realize and maybe we can discuses it with them and sort out their problem, maybe they have questions they need to be addressed.
