Asalaam o Alaykum,

”Allah humma sallay Allah Muhammadin Wa Ali Muhammad”.

I have a question about my exhumation of my father’s father’s body to another grave site.

He passed away 15 years ago (may Allah grant him jannat Ameen), the site however is on the opposite end of the city. The drive is long and we have to use the high way. I don’t live in that country anymore, so my mother doesn’t get to see  him frequently since she’s scared to go on the highway , but there is a grave yard 10 mins drive from where we live where she would be able to go.

My mother is in her 70s.

I want to know if this is permissible under Shia jurisprudence and sources if possible please.

Salam. When I googled the price of exhumation and burial in a different cemetery, it was $8,000 to $20,000 depending on where you live. It would be nice if you hire a driver to safely take your mother to the cemetery where your father's remains are resting.

generally scholars were only allowing this in the case that the body was being transferred to Jannatul Mulla Jannatul Baqi Wadi Salam or the graveyards of karbalah khadhimain samarah mashad qum near one of the holy ones

It is not theoretically impossible for a legitimate reason like to see if a person was murdered for DNA testing to see if it was actually the missing person buried in the grave or who it was supposed to be or something

However, take in mind from Islamic history when the holy prophet, peace, and blessings, be upon him moved from Makkah to Madinah knowing he would not come back, he did not transfer the bones/bodies of his ancestors to new graves, nor were the holy ones, other than the 72 transferred back to Medina etc

Something to think about

If there was a flaw that caused the bodies to become unburied or in some cases bombings the damage the graveyard then usually they need to be re-buried there if for some reason the graveyard had to be moved, it was too damaged even this should only be done in the most extreme of circumstances

So as the above post  mentioned, maybe hiring a driver on Fridays or one Friday a month would be a better option

wallahu Alam
