yes their are quite a few that disagree with the system of wilaytul faqih , such as sayed sadiq shirazi , and many other scholars from the shirazi lineage , also sayed ammar nakhshwani disagrees  with it but in a more neutral way and I also think sheikh usama al atar and sayed mahdi moddressi disagree with it as well , their are many more maybe other members can name them , may peace and blessings be with you

Ok, I know many people won't like this post but it's relevant. Some of these scholars may not be completely against the WF, but all of them had issues with that system.

1. Grand Ayatollah Sayed Kazim Shariatmadari. He was accused of being part of a coup against Ayatollah Khomeini, and he was prisoned and placed under house arrest. Ultimately he got very sick and had no access to medical treatment, which led to his death and his burial was done in the most degrading condition possible.
2. Grand Ayatollah Ali Safayi Qomi. He was the son of Grand Ayatollah Mohammad Ali Safayi Qomi. He was prosecuted by the special revolutionary court for clergymen, due to fragile and flimsy accusations and placed under house arrest, which led to his suspicious death.
3. Grand Ayatollah Sayed Ahmad Khonsari. He was accused of being against vali Faqih (Ayatollah Khomeini) and was placed under house arrest and ultimately died in a suspicious way as well. His burial ceremony was violated by revolutionary intruders.
4. Grand Ayatollah Sayed Hassan Qomi. He was accused of being against Vali Faqih and placed under house arrest after being attacked by revolutionary mercenaries. His death have raised many questions and his burial ceremony was banned and only few people were allowed to attend.
5. Grand Ayatollah Sayed Reza Sadr. He was the brother of Sayed Moosa Sadr who was an active Shi’a political reformer in Lebanon. His crime was that he prayed on the body of late Ayatollah Sayed Kazim Shariatmadari, and he was placed under house arrest, which ultimately led to his death.

He was placed under house arrest and passed away in mysterious circumstances. His house was attacked numerous times by revolutionary intruders and he was accused of being astray and corrupt as a Muslim. He was known for his extensive knowledge in genealogy, and he had announced that Ayatollah Khomeini’s genealogical roots were unclear and doubtful. Due to his high status and large base among the Shi’a Muslims, the Iranian regime was not able to place him under house arrest, but he was abused and harassed in numerous cases.

He was accused of being anti Vali Faqih and placed under house arrest, and banned from all types of religious and academic activities under the reign of Ali Khamenei.
17. Grand Ayatollah Yasoob Aldeen Rastegari. He has been jailed for several years due to his affiliation with Ayatollah Sayed Kazim Shariatmadri and being Anti Vali Faqih. Currently, he is under house arrest and lives in the city of Qom.
18. Grand Ayatollah Sayed Sadeq Shirazi. He is the younger brother of late Grand Ayatollah Sayed Mohammad Shirazi. He is accused of being anti Vali faqih and many of his centers and affiliate institutions have been closed and confiscated. Recently the Iranian government have imprisoned several individuals within his close circle and label him as traitor and enemy of Islam.
19. Grand Ayatollah Mohammad Tahir Shoebiri Khaqani. He was a prominent scholar in the Khozestan province in Southern Iran, who criticized the racial and arbitrary policies of the Iranian regime. He was exiled to Qom and placed under house arrest and ultimately died in mysterious circumstances.

Some media claim that many Shia scholars and marjas against "wilayat faqi" and they try to introduce them as the opponents of Islamic republic of Iran. But the problem of this group is that they forgotten that they have the different principles and it isn’t related to the nature of Islamic republic of Iran.

For example, some scholars restricted the role of faqih to the administration of justice (Wilayat al-qada) and ‘hisbah’, but some others also believe that Faqih has the right to exercise governmental, juridical and economic duties.  

Another point which should be considered is that nobody of scholars was arrested for being anti wilayat faqih. If you see a few of them arrested be sure that they were complained.

Also in recent events regarding the revolt in Baghdad,

They were mostly Muqtada Al-Sadr supporters and they shouted anti-Iran slogans.

I think sayed fadlullah also denies its proof from the islamic scriptures. I dont know if he personally believe in it or not though, but based on his speech's and interviews, i guess he does deny the existence of this topic in islam and reverts to other ways.

Like I said, it seems like a lot of people are really putting out names of scholars who don't really oppose Wilayat al-Faqih. 

Sayyed Muhammad al-Shirazi actually believed in Wilayat al-Faqih, he just differed with Sayyed al-Khomeini on some issues.

Shia community must be led by an Imam and when the Imam is not present the most similar one is a pious faqih. 

And how can Shias -whose idea is that Islamic community after the prophet wasn't left to stay on its own and must be led by a divine leader- think that Islamic community during the time of occultation is left to stay on its own?!!!

This is an obvious fact accepted by all scholars.

I don't how much you know Arabic but Ayt. Muhammad hassan Al-Najafi the author of the famous feqhi book Javaher Al-kalam -which is now taught in almost all of high advanced Feqhi classes - has stated as follows:

This is surely not true, brother.

I live in Iran and know much better what's going on here in Iran. It is not like what you said that these scholars were attacked by revolutionary soldiers. They were/are not anti government but its defenders.

Only a few of mentioned scholars started opposing the government like Shirazi, Montazeri.

It's a long story why each opposed the government.

For example: Shirazi ignores what Ayt. Khmenei says about the unity among Muslims and has always wanted to stir up troubles between Muslims. 

Montazeri had a son in law who had done disgusting acts and even has killed one of the great scholars in Isfahan( shams Abadi) and after his execution Montazeri was removed from his post. He couldn't do anything when Ayt. Khomeini was alive but after his demise he set to oppose Ayt. Khamenei.

It's good to know that neither of them were banned from academic activities; Shirazi every day holds his academic class in a mosque near the holy shrine of Lady Fatima (as) which is called Zain Al-Abedin.

You clearly dont see hadith of the flags of Khorasan

Insha'Allah the brother/sister here doesn't have bad intention, but what they are calling truth is misinformation.

I don't know all the anti Welayate Faqih people/scholars mentioned here, and if they even exist, or if they exist, they are good scholar or bad scholar. Anyways, there are some issues I am going to address:

1. Ayatollah Khoei wasn't against Welayate Faqih. He even was among the people who were trying to establish Islamic government in Iraq.

 

2. Regardless of his personality, Marhouhm Montazeri has wrote a book for Welayate Faqih, how can he be called against Welayate Faqih? As it was mentioned, he was removed from the next leadership post, as a result of some of the issues back then like his openly support for his son in law's brother named Mehdi Hashemi who was leading an extremist and terrorist-like group. 3. Shari'at madari was a close person to Shah and against Imam Khomeini's uprising against him. After Revolution, he alongside some other anti Revolution individuals (especially his son in law, Ghotb zadeh) managed a coup against Imam Khomeini and as far as I know, even tried to kill him. But by the grace of God they failed and were arrested. Here are Ghotb zadeh and Shari'at Madari's confessions (in Persian):

I have more things about a few of these kinds of  scholars whose names mentioned here. But what I said is enough for some members here to, at least, be more cautious in their ways.

Insha'Allah we can learn to distinguish between Good scholars and bad scholars, as nothing has damaged Islam more than bad scholars.

Salam,

After reading some of the posts here, I just wanted to jump in and give my 2 cents. 

I know a lot of shias believe in Wilayat Fagih and love it. That's good. If you feel like it's a great system, then it's your opinion. 

I, personally, don't believe in Wilayat faqih, but that doesn't mean I'm against Iran and certain scholars like Ayaltallah Khomeini and Ayatallah Khamanai. 

The thing is I kind of get annoyed when shias place Wilayat Faqih on par with imamate or usool e deen. As far as I know we only have 5. 

I think it's totally wrong to equalize it's importance with the fundamentals of religion.

Wasalam bro/sis see there is nothing wrong with difference of opinion when we discuss it with manners the way your doing it there is no wrong in it but when certain people come and slander and accuse our scholars with some fake weak evidence from zionist agents then thats a problem

I can say with quite a degree of certainty that I was one of the most anti Iran/ anti WF/ Anti Khomeini members on shiachat for many many years. I have spent literally years digging up dirt about the WF system and posting it here. any sort of controversy regarding Iran was good news for me.

My views have softened recently. What I realised is that there is not Iranian conspiracy involving all scholars of all levels within all levels of society, government and seminary, all working towards a single goal of a global shia pope.

the majority of people in Iran are regular, decent, hardworking honest folks like us, doing the best that they can under extraordinary conditions and pressures with limited resources.

just because there is a corrupt core of turbans within Iran, this does not mean that every single person in Iran is evil. show me a single country to ever have existed (masumeen excluded) where there was not a corrupt bunch of people at top levels of government using corruption to make themselves rich.

if the iranians choose the WF as a political model to rule their own country - and there is absolutely zero doubt that the majority of Iranians do - then this is their right, and no one has any right to impose what they do not want on them.

there is a hard core of WF supporters who believe wacky things like the wilayat of sayed khamenei is the same - global - wilayat as Imam Mahdi (atfs)

so basically - what Iranians choose to do in terms of politics within their own country is their own issue and none of our business.

when nutcases (mostly online) decide to call sayed khameni the global leader of all the worlds muslims whether shia or not, whether they accept him or not etc...then we have a problem.

you will find when you actually study scholars who disagree with WF, that they actually only disagree with the level of power the WF has. sayed muhammad baqir shirazi for example believed that it was better to have a council of equal WFs instead of a single one. most/ all scholars believe however that the faqih has some position in terms of politics.

It's no secret that the regime prisons the clerics which they don't like.

It's not something too unlikely to happen, i wouldn't be surprised if the story is true.
