Vital Organ Donation After Death

Salam, 

 

Are there any valid arguments, based on textual evidence, that forbids vital organ donation after death? For example, is it permitted to donate one's heart after death to save a life? 

 

Are there any hadiths from Ahlul Bayt (as) that can be used to conclusively determine this matter?

I've actually asked the same question. 

In short, you are allowed to donate if the recipient is muslim. This is because their body is not najis. 

That's the short answer :) 

 

I think I came across a sistani fatwa that says it is okay to donate if it's to a muslim too. Check with your own marji3 :)

In my humble opinion, a Muslim should donate it for free to the most needy or to someone who is likely to make the world better. But to be honest, I'm not completely comfortable with the idea. I don't want my ghost to get stuck to the darn organ staying alive or something similar. That would then become an unimaginably big mistake.

1Question: If an organ of an atheist is transplanted in a Muslim’s body, would it be considered ritually pure (tãhir) when it is considered, after transplantation, as part of the Muslim’s body?

Answer: An organ extracted from the body is ritually impure (najis) irrespective of whether it came from a Muslim or a non-Muslim. And when it becomes, by rejuvenation, part of a Muslim’s body or of someone who is considered a Muslim, it becomes tãhir.

2Question: Are we allowed to donate our organs upon our death? For example our heart, liver, kidneys? Is the soul still attached to the body once we are dead, or is that not true?

Answer: It is permissible, but it is not permissible, as a measure of precaution, to cut an organ of a dead Muslim if he bequeathed, unless a Muslim’s life is in danger.

Thank you for your replies. 

 

My main concern at this point is to see how scholars reach their conclusions. 

What evidence or information from the Ahlul Bayt (as) do they use to reach their decisions?

What informs them? 

 

I'd like to know more about the teachings of Ahlul Bayt (as) that can be connected to this issue than the opinions of scholars.
