So just to clarify, taqleed is: cheery picking the opinions from the buffet of Ulama (1st port of call Nader Zavari of course) till you find an opinion that falls into line with what you would rather be the case.

And to think i was accused (and critisised) for 'cherry picking'. Oh how juicey.

No. Go and learn about taqleed and what obligatory precaution means, and then come back.

No. Go and learn about taqleed and what obligatory precaution means, and then come back.

Well, i believe i know what obligatory precaution means: being cautious for fear of transgressing Gods limits, and i think its a very good idea as God repeatedly cautions against this in Quran.

No that's not what it means. Basically what it means is that the marja doesn't want to make a definite fatwa (presumably because he isn't 100% sure), which it would be obligatory to follow, so rather he makes one out of obligatory precaution, which means that if the one who does taqlid so chooses, he can consult the person he considers to be the next most knowledgeable after his marja. And if that person hasn't made a definite fatwa either, then he can consult the next most knowledgeable person after him, until he comes to someone who has given a definite fatwa (i.e. a ruling with no obligatory precaution).

Also I have noticed that many people think there is nothing wrong with searching around until they get the answer they want to hear (not accusing anyone here).

Because a person may be more knowledgeable in one area of fiqh even though they are generally less knowledgeable that another person.

This is the exact reason why I personally don't do fatwa shopping or follow too many scholars.

The explanation about obligatory precaution is correct. The other detail that I was told is that in order for the obligatory precaution to work is when your own marja say that you can follow opinions of other marajas and he need to elaborate which other opinion you should/you can refer to. I have not seen much elaboration in the risala of the marajas.

when you come to some one who has a definite fatwa without precaution it could be permissible or impermissible its not your choice so why are you accusing people of following what they want to hear ???

how do they gurantee that the difinite fatwa is what they want to hear

for exampel eth muta with prostitutes some say to avoid it out of precaution and some others like

roohullah khoomainie said its permissible with karahyah

so automaticly the buttom line openion of the mathhab would be the permissibility not the impermissibility

a schoalr is asked about this and he said : the buttom line is the permissibility with karahyah

this is because those who allowed it did not give precautions and hence thier openion is the buttom line not the openion of those who declared that they are not sure ....

same thing with the permission of the rashida virgin you have some who said you need it as a precaution and some who said you dont need it full stop... automaticaly the second answer becomes the buttom line openion of the mathhab i.e. the permissibility.

I wasn't accusing anyone.

I was simply explaining my preference. That preference being when I am told to avoid something about of obligatory precaution I choose to just avoid it because I don't feel comfortable going to the next person down the line....it would cause too many doubts to run through my mind.

However I have seen some people shop around and not stop until they find a a fatwa fitting his or her desires.....and you can't deny that some people do this.

By the way did you overlook this part of my post?

I have been down with migraine for two days and my sisters were having a party here,

Oh those are the worst! I will be having lots of migraines in the next month because it's Ramadan....so fasting mixed with summer! It's bad because I have to get up and do all of the cooking on my own even though I can't stand the smells and light.

Yes, I know--to be honest I am also trembling with trepidition thinking of Ramzan in this heat ( it would be my first Ramzan in this hot climate ) to make things harder I am addicted to coffee and moreover I prefer to do the cooking for my Baba myself.

I was excited about a migraine patch that delivers medication into your system without having to eat any medicine....but it hasn't been released on the market yet :(

The fasting, last year, was very tough for me. I was fasting for 14-15 hours in over 100 degree F. I got at max 4 hours of sleeping every night. And I couldn't eat anything when I opened my fast because I was exhausted. And on top of it, I couldn't even eat anything at sahoor.

We won't have a winter ramadan until around 2025 I think :cry:
