Solutions for the Problem of Inheritance

Asalam Alaikum, I have been trying to get a solution for division of inheritance among the heirs of the deceased and on the model of Imam Ali's solution of 17 Camels among three people have discovered this method, I would encourage the critical analysis of this method by an Alim of Imamia faith and correct me if I am wrong. Still, I am working on other problems and insha-Allah, with time will fine their answers. With your critical analysis, it may be that I could find other weaknesses and make it further appropriate, at this time, I am making thread of this so as to save it for copying from this thread as well. Regards.

Problem:- A deceased left 20,000 dollars as inheritance for his 3 sons, 4 daughters and a wife. How could this be divided among the heirs of the deceased ? 

Solution:- 

a) a wife will have 1/8th from the deceased

that amounts to 20,000 / 8 = 2,500

b) the share of the son from the property of deceased with respect to the daughter is 2 : 1, so, we have to make three parts of 20,000 assuming no share for the mother for the purpose of solving this problem right now: 20,000 / 3 = 6,6667.

Now, for sons, the share will be to be divided among 3 sons 13.333

and for sisters, the shares will be 6,6667 to be divided among 4 daughters.

Now, calculating all shares together: 13,333 + 6,6667 + 2,500 = 22500 = total +error.

error is 2,500 to be divided among three heirs that is 2500 / 3 = 833.33

Now, subtracting that amount of error, will make up total = (13,333 - 833.33) + (6,6667 - 833.33) + (2,500 - 833.33) =  12499.67 + 5833.67 + 1666.67 =  20000.01 with slight error but if you want to neglect it then follow the same procedure and insha-Allah, it will be fixed.

If you assume instead he had 10 daughters, you may reach a solution faster.

1. Remove the mother.

2. Give money to the daughters ($2000)

3. Get the mother's money back ($250 from each daughter.)

Thus:

Daughters: 1750$ each. (7000$ total)

Sons: 3500$ each. (10500$ total)

Mom: 2500$.

Total: 20000$

How did you do that ? I would like to know that why 250 dollars deduced from daughters but not sons ? 

Could you elaborate ?

Similarly, by Supposing sons to be five , we have: 

4000 each son and giving away share of mother that is 500 from each son making up five to be 2500. 

3500 for sons than half for sisters will be 1750 for a girl. 

for 3 sons 3500 each make up 10500

for 4 daughters 1750 for each making up 7000

and for mother 2500....

quite correct hence proved. 

10500 + 7000 + 2500 = 20,000

I found an error in my above method, the mother share does not need to be cut as it is 1 / 8th of the total property and further cutting would be usurping her right. 

The Boys got much share and daughters got lower share, will fix it's methodology.

I have finally found the mistake in my solution as well:

Solution:- 

Give away the portion of mother that is 1 / 8 of 20,000 = 2500

Remaining amount is 17,500

Now, the ratio of sons to daughter is 2:1 but total sons are 3 and daughter are 4, so muliplying with ration will make it 3(2) : 4(1) = 6:4

that is ten shares out of which 4 belongs to girls and 6 to boys. 17,500 / 10 = 1,750

1,750 +1,750 +1,750 +1,750 +1,750 +1,750 +1,750 +1,750 +1,750 +1,750 = 17, 500

Each girl gets 1750 and four shares for them,

For boys, there are six shares but three boys so, each of the additional share will be retained by each boy or make total of six shares and divide by 3 boys. 

total of six shares is 10,500 total share of boys and divide by 3 gives us share for each boy = 3,500 for each boy.

@Bakir It could be simple for you but it is a discovery for me :worried:. I just wanted a step wise method in an arithmetic way to divide shares, it took easy as you described and it was a great information for me as well and benefited me, Alhamadolilah by teaching my mistakes and form this way.

    • Salaam brother, I have heard more than one aalim and even marajae encourage studying sciences and pursing professional degrees. You can serve islam just as well being a civil engineer, doctor, accountant as you can being an aalim.
    • If you are a mu'min then you will eventually be let into Heaven. But if you were a sinful and a transgressing person, some say you may be punished for a while in Jahannam for your actions. Now, the question is: what if you didn't pray or go to Hajj or fast in Ramadhan or pay obligatory zakat? Will you still be considered a mu'min in the Afterlife?  That question is interesting.
    • I haven't seen a specific narration. It seems to be the reason some fuqaha have this ruling is because it comes under nahi an al munkar. Also, some fuqaha say all sins are punishable under the Islamic court - and this is done through ta'zir. And not wearing hijab would be a sin.
    • It is the best option. Even if it means having one less sin under your name, that means something in Islam. @notme they are much better for boys. Trust me I know from personal experience. If you were to be present in some of the conversations that boys have in the playground about girls you might faint lol
