What to do if there is "NO FATWA"?

Assalamu'Alaikum.

 

If there is no fatwa of your Marja (mine is Ayatullah Sistani) on a particular issue/topic. What is it that you must do next?

i. Follow another Marja?
ii. Or consider the act permissible?

 

For example, I find no fatwa on Zanjeer Zani / Blood Matam by Ayatullah Sistani (according to what I have come to know), so do I follow another Marja, whom I deem knowledgeable, and follow what he say on this particular issue (Like Ayatullah Khaemenei?), or can I consider the act of Blood Matam permissible if there is no fatwa by my marja regarding it?

Anything not prohibited is permitted. 

In this particular instance, if the act would be considered self-harm it isn't permitted. If there is no significant harm, it's not prohibited nor encouraged.

It depends upon the act whether it is spiritually advantageous or will harm your Iman, you will have to look at the consequences of the actions.

Actually Zanjeer Zani or Qama Zani itself is not haram or halal. Its the circumstances which are making it so. Those scholars who have prohibited it have issued such fatwa because of apprehension of damage to the image of Islam. I have been doing Zanjeer Matam but have stopped doing so. I am also Muqalid of Ayatullah Ali Sistani (hz) and remained confused in this regard because Ayatullah Sistani has not issued any fatwa on this matter. Some followers of Ayatullah Sistani follow fatwa of Ayatullah Ali Khamenai in this regard and do not do Zanjeer Zani (Like me) while others do this by acting on Fatwa of Ayatullah Wahid Khurrasani. There are many reasons why i stopped doing it but the main are following:-

1. There is very much show off in this. Unfortunately, people do this for the sake of others. They use white cloths so that people may know they have done Zanjir Zani.

2. One has to remove his Kameez in public place especially when women are in the procession and there is every chance of their seeing our bodies which is haram.

3. It definitely give bad image. Blood every where on your head, on your cloths. A non Shia muslim and a non muslim is often unable to understand it and brands Shias as barbaric people.

4. Its out of very few issues where Fatwas of scholars vary from Halal to Haram. This phenomena is not common among scholars. In many issues their fatwas vary from Makrooh to Haram. It very rarely happened that one thing is Halal before one scholar and haram before another scholar. Zanjeer Zani is such an issue. Therefore, this is a controversial issue and a believer should avoid such acts regarding which there is huge difference among scholars.

Have you read the clarification about tatbir that Sayyid Muhammad Hussain al-Amidi made? He is a representative of Ayatullah Sistani.

In a place where a faqih has not issued a fatwa or is silent, the mukallaf is required to refer to the second most knowledgable faqih for this particular issue.

No doubt it had spiritual effects but i found it more spiritual now quitting it. Because i have started understanding the true object/purpose of Imam Hussain a.s in Karbala. There are certain innovations in Azadari which i think should be avoided because they are destructive to the very purpose of Imam Hussain a.s in Karbala. Its my humble opinion which of course is not acceptable to many Shia brothers and sisters. Even my own family members differ from me. They believe Zanjeer Zani is part and parcel of Azadari and there is no Azadari without it.

    • Is there some reasonable idea to block corporate interests from getting into politics? When you also look at pictures like this I uploaded it makes you think whether these groups are unstoppable. Did Bernie Sanders have any policy to help end corporate money from getting into politics? I know he talked a lot about campaign finance system but I am sure that isn’t the only way money gets into politics.  What about breaking banks up by ownership to ensure that not only an oligarchy is destroyed but also consumer competitiveness starts to become a thing again. Or maybe we just need everything to collapse so we can get to rebuilding and not waste any more time? America has been doing nothing to limit their deficit because I’m sure they know there is absolutely no credible way to pay a sum like they owe back. Sit back, relax and watch it all burn to the ground. Maybe another communist revolution or two and see how it all goes. Income equality is already making the masses angry if you tell them one day you don’t know where their next salary is going to come from...kaboom.  Im more of a centralisation kind of guy.
    • How old is she? Do you know her friends? Buy some beautiful modest dresses and tell her that she looks more beautiful when she wears them. Ask your mother to do the same.
    • Shirazi and his muqallids are not part of a cult, I don't agree with him but I do notice that a lot of people say things about him that aren't true.
    • I am sorry to hear that, at least you tried.  But I like said, there's nothing you can really do except pray and understand that in the end, her decision doesn't affect anyone but her and nobody but herself is responsible her choices in life.
